Terms of Service
1. Agreement
These Terms of Service (the "Terms") govern your use of the Robin mobile application ("Robin" or the "App") provided by Rize Software LLC, a New York limited liability company ("Rize Software", "we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms supplement Apple's Licensed Application End User License Agreement (the "Apple EULA"). In the event of a conflict, the Apple EULA governs to the extent of the conflict.
2. About the App
Robin is an unofficial application for reading works published on the Archive of Our Own ("AO3"). Robin is not affiliated with, endorsed by, or sponsored by AO3 or the Organization for Transformative Works ("OTW"). "Archive of Our Own" and "AO3" are names of the OTW.
3. Eligibility
You must be at least 13 years old to use the App, consistent with the minimum age required by AO3.
4. AO3 content and accounts
Works and other content displayed in the App are retrieved from AO3 and belong to their respective creators. Rize Software does not host, own, or claim any rights in that content.
Your use of AO3 through the App, including any AO3 account you use, is subject to the AO3 Terms of Service. You are responsible for your AO3 account and for complying with AO3's terms and policies.
AO3 hosts works intended for a wide range of audiences, including mature and explicit content. The App displays the ratings and warnings provided by AO3; you are responsible for your choices about what to read. We do not control AO3, and content may change, become restricted, or be removed, and AO3 may be unavailable, at any time.
5. Acceptable use
The App is provided for personal, non-commercial use. You agree not to:
- use the App to bulk-download, scrape, copy, or redistribute works;
- use the App in a manner that overloads, disrupts, or impairs AO3;
- use the App to violate the AO3 Terms of Service, any applicable law, or the rights of others; or
- interfere with, reverse engineer for unlawful purposes, or misuse the App or its related services.
6. Donations
The App is available without charge. You may choose to make a donation to support its development. Donations are voluntary, are processed by Apple through the App Store, and do not unlock any features or content. All features of the App are available to all users. Requests for refunds are handled by Apple in accordance with its policies.
7. Feedback
If you submit feedback, suggestions, or ideas, you grant us the right to use them to improve the App without obligation or compensation to you. Our handling of information you submit is described in our Privacy Policy.
8. Intellectual property
The App, including its name, icon, and design, is owned by Rize Software LLC. Subject to these Terms and the Apple EULA, you are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT CONTENT FROM AO3 WILL BE AVAILABLE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIZE SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR FIFTY U.S. DOLLARS (US$50). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Termination
You may stop using the App at any time by deleting it. We may modify, suspend, or discontinue the App, in whole or in part, at any time.
12. Changes to these Terms
We may update these Terms from time to time. We will post any changes on this page and update the effective date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles. Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of the place where you live.
